Debt collection and repossession specialist
Burlington Credit has launched a service for enforcing decrees for
the delivery of motor vehicles in Scotland.
The service is similar to its High Court writ
of delivery product for enforcing County Court ‘return orders’ in
England and Wales – and makes Burlington the only asset
repossession company offering a full post-judgment enforcement
service, to recover assets subject to court orders, across the
whole UK mainland.
Business development manager Adam Wonnacott
said: “Our enforcement products are provided on a fixed, contingent
fee basis. Sheriff officer fees are generally calculated on a ‘time
spent’ basis, so we are confident that a fixed-cost service will be
well received and will help our clients to keep an eye on
costs.”
“It’s generally accepted within the industry
that decrees for delivery in Scotland need to be enforced using a
court process, and that creditors cannot simply repossess on the
strength of the decree itself. In fact, the process in England and
Wales is quite similar, in that enforcement of County Court return
orders must be undertaken by compliant means under the Civil
Procedure Rules.
